JUSTICE RAKESH KUMAR ORAL ORDER 17-08-2016 Heard Sri Shubhesh Pandey, learned counsel for the petitioner and Sri Abhay Kumar, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 08.04.2016 in connection with Samho P.S. Case No.06/2016 registered for the offence under Section 414 of the Indian Penal Code and Sections 25(1-a), 26(iii) of the Arms Act, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. He submits that on checking of one motorcycle, two accused persons were apprehended, from whose possession some cartridges were recovered and on their disclosure, so called raid was conducted, where recovery of one country-made pistol from
Patna High Court Cr.Misc. No.32070 of 2016 (3) dt.17-08-2016 2/2 the possession of the petitioner was shown. It has been highlighted that the petitioner is having clean antecedent. Learned Addl. Public Prosecutor has opposed the prayer for bail of the petitioner.
Keeping in view the nature of accusation, period of custody as well as clean antecedent of the petitioner, as mentioned in paragraph-3 of the petition, let the petitioner, namely, Ram Ekbal Chaudhary be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Begusarai in connection with Samho P.S. Case No.06 of 2016.
