JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 08-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Behri P.S.Case No. 93 of 2019 for the offences punishable under Sections 436, 453, 504, 506/34 of the Indian Penal Code.
Learned counsel for the petitioner submitted that petitioner no. 1 namely, Ramchandra Yadav has been arrested. Bail prayer of the petitioner no. 1 is dismissed as withdrawn. As per allegation in the F.I.R, petitioners along with other co-accused setting fire in the hut of the informant. Learned counsel for the petitioner submitted that

It is further submitted that no one has received burn injury only utensils and house hold articles of the informant were burnt. Learned Additional Public Prosecutor opposes the bail prayer of the petitioner.
Considering the facts and circumstance of the case as well as submission of the parties, let the petitioners in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Darbhanga in connection with Behri P.S.Case No. 93 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
