JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 47(a) of the Excise Act. 200 litres of toddy, loaded on a tempo, was recovered and at that time, the aforesaid tempo was being driven by the petitioner, who is languishing in jail custody since 20.05.2016, without having any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Excise Case No. 58 of 2016.
