JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Dehri (Dalmianagar) P.S. Case No. 530 of 2014 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47 A of the Excise Act.

Admittedly, the seized motorcycle belongs to petitioner and the seized liquor was found laden on the above stated motorcycle.

Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to grant the privilege of anticipatory bail to the petitioner and

Patna High Court Cr.Misc. No.22060 of 2015 (2) dt.07-07-2015 accordingly, his prayer for anticipatory bail in connection with Dehri (Dalmianagar) P.S. Case No. 530 of 2014 pending in the court of Sub Divisional Judicial Magistrate, Dehri, Rohtas stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
