2. Petitioner apprehends his arrest in connection with Dhaka (Pachpakri) P.S. Case No.438 of 2021, registered for the offences punishable under Sections 30(a), 41(1), 32 of the Bihar Prohibition and Excise Amendment Act, 2018, pending in the Court of learned Exclusive Special Excise Court No.1, East Champaran, Motihari.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned
