JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 272, 273 of the Indian Penal Code and 47 of the Excise Act.

Three litres country made liquor, 5 kg. dry Mahua and other apparatus which have been used in manufacturing country made liquor were recovered from the house of the petitioner for which petitioner is in jail custody since 17.6.2016. Submission on behalf of the petitioner is that nothing has been recovered from the house of the petitioner and the present case is nothing but highhandedness of the police. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Saran at Chapra in connection with Nayagaon P.S. Case No.46 of 2016.
