The petitioner seeks bail in Madhuban P. S. Case No. 330 of 2017 instituted for the offence under Section(s) 414 Indian Penal Code and Section 25(1-b)a, 26 of the Arms Act. It is alleged that one loaded country made pistol and two live cartridges were recovered from the possession of the petitioner.

Petitioner is in custody since 23.12.2017.

It has been submitted that in the seizure list reference has been made of Glamour motorcycle. But the aforesaid motorcycle was not stolen article. The petitioner enclosed the

No.55235 of 2018(2) dt.20-09-2018 2/2 sale letter of the said motorcycle which shows that said motorcycle was registered in the name of Abhay Nandan Singh and petitioner has purchased the aforesaid motorcycle from Abhay Nandan Singh. Petitioner has enclosed the relevant documents as Annexure-2 to the bail petition. Considering the aforesaid as also keeping the view the period spent by the petitioner in custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the 4th ACJM, East Champaran at Motihari, in connection with Madhuban P. S. Case No. 330 of 2017 subject to the condition that both the bailors shall be the close relative of the petitioner.
