The petitioners seek bail in Jagdishpur P.S. Case No. 397/2017, instituted for the offence under Section 376D of the Indian Penal Code.

Learned counsel for the petitioners has submitted that in the written report there is specific allegation against co-accused Md. Muddasar. Petitioner is not named in the written report. His name has come in the confessional statement of Md. Muddasar. The victim girl in her statement recorded under Section 164 Cr.P.C. has not taken the name of these petitioners. The petitioners are in custody since 22.06.2018.

Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Additional District & Sessions Judge, Bhagalpur in connection with Jagdishpur P.S. Case No. 397/2017 (S.Tr. No. 19/2018), subject to the conditions that both the bailors shall be the close relative of the petitioners.
