The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 447, 341, 342, 323, 324, 307, 379, 354(A), 504 of the Indian Penal Code.

The prosecution case as per F.I.R is that all the accused persons including petitioners, variously armed surrounded the husband of the informant. It is specifically alleged that co-accused Shriniwas Singh inflicted sword blow on the head of husband of the

Patna High Court CR. MISC. No.61848 of 2021(2) dt.05-07-2022 2/3 informant. It is alleged against petitioner No. 1 that he assaulted with iron rod on the back of her husband whereas petitioner No. 2 is alleged to have snatched golden chain.

It is submitted by learned counsel for the petitioners that petitioners and informant are agnates and in the background of some previous dispute, the present F.I.R has been registered. The petitioners' side have lodged Barauli P.S. Case No. 148 of 2021 against the informant and other family members. Hence, in order to put pressure upon the petitioners, this false case has been registered against the petitioners. Moreover, injury report does not corroborate the prosecution version as against the petitioner No. 1 since the husband of the informant received injury on his head, grievous in nature which is alleged to have been caused by co-accused Shrinivas Singh. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

No.61848 of 2021(2) dt.05-07-2022 3/3 In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gopalganj in connection with Barauli P.S. Case No. 147 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
