JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 11-03-2016 in a case initially, registered under Section-307 & other minor sections of the Indian Penal Code but later on, Section-302 of the Indian Penal Code was added.

The alleged occurrence appears to have taken place on account of land dispute and it is alleged that the deceased and others were assaulted by petitioner and other accused. However, it is specific case of the prosecution that co-accused, Bishuni Ram gave Lathi blow, causing head injury to the deceased whereas; the petitioner is said to have given farsa blow, causing injury to the wife and the daughter-in-law of the informant. Both the aforesaid

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Uchakagaon P.S. Case No. 33 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gopalganj.
