The petitioner is languishing in custody for the offence punishable under Section 304(B)/34 of the Indian Penal Code.
Petitioner is husband of the victim of dowry death. Petitioner is in custody since 06.04.2018.
In the past prayer, bail was refused to the petitioner on 11.10.2018 vide order at Annexure-1, with direction to the learned trial Judge to expedite the trial. It has been informed that only commitment of the trial has been made recently.
Considering the aforesaid facts, let the petitioner, above named, be released on bail after framing of charge on
Patna High Court CR. MISC. No.49395 of 2019(5) dt.21-01-2020 2/2 furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Teghra P.S. Case No. 194 of 2017, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
Learned trial Judge is directed to frame charge at the earliest.
