The petitioner seeks bail in connection with Bhore P.S. Case No.35 of 2016 registered under Sections 272, 273 and 420 of the Indian Penal Code besides Section 47(A) of the Bihar Excise (Amendment) Act, 2016 and Sections 25(1-b) and 26 of the Arms Act.
The accusation is that in course of search of the house of the petitioner, on digging the filed of the petitioner, situated near house, 35 bottles foreign liquor, each containing 180 ml., 398 bottles bear, each containing 650 ml. and one pistol were recovered from there.
Patna High Court Cr.Misc. No.27840 of 2016 (2) dt.14-07-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that it would appear from the seizure list that the alleged articles were recovered on digging the earth outside of the house of the petitioner and not from the house of the petitioner. The petitioner having no criminal antecedent is in custody since 20.04.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Bhore P.S. Case No.35 of 2016.
