JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2018 Earlier prayer for bail of the petitioners was rejected by this Court vide order dated 20.4.2017 passed in Cr.Misc.No. 9667 of 2017 and allegation against the petitioners is of committing murder of the deceased.

Submission of learned counsel for the petitioners is that deceased died of snake bite and similarly situated co-accused has been granted bail by this Court vide order dated 18.7.2018 passed in Cr.Misc.No. 42473 of 2018 and petitioners are in custody since 20.11.2016.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail. Having heard both sides and in the facts and

No.57890 of 2018 (2) dt.19-09-2018 2/2 circumstances, as stated above, let the petitioners, named above, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions JudgeII, Banka, in connection with Sessions Trial No. 148 of 2017, arising out of Banka P.S.Case No. 635 of 2016, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioners have to co-operate in disposal of trial and appear in court as and when required, otherwise their bail bonds shall be cancelled.
