The petitioner seeks bail in a case registered under Sections 419 and 420 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the allegations made in the FIR would not attract the ingredients of the offence punishable under Section 420 of the Indian Penal Code and Section 419 of the Indian Penal Code is bailable in nature. It is further contended that co-accused Rajnish Kumar Gupta and Anil Kumar having identical allegation have already been granted bail by a Bench of this

Patna High Court Cr.Misc. No.35249 of 2016 (2) dt.20-08-2016 2 / 2 Court vide order dated 12.08.2016 passed in Cr. Misc. No. 31301 of 2016.

Be that as it may, regard being had to the nature of the allegation, the petitioner, who is in custody since 15.05.2016 and against whom investigation has already been completed, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Araria in Jogbani (Bathnaha) P.S. Case No. 65 of 2016.
