The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147/148/149/307 of the Indian Penal Code and 27 of the Arms Act and 3,4 and 5 of the Explosive Substances Act. It is alleged that on protest being made by the police against obstructing road, the FIR named accused and 20-30 unknown pelted stones on the police.

It is submitted by learned counsel for the petitioners that except presence of the petitioners at the place of occurrence

Patna High Court Cr.Misc. No.15660 of 2015 (2) dt.04-05-2015 2/2 there is nothing specific against the petitioners and for the alleged occurrence the police also lodged Amparpur P.S. Case No.235 of 2014 against the informant and others. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Amarpur P.S. Case No.234 of 2014, pending before the learned Chief Judicial Magistrate, Banka.

With the above observation, this application is, accordingly, disposed off.
