JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,149,341,323,504,354379 and 448 of the Indian Penal Code. The accusation is of entering into the house, making assault to the informant and snatching gold chain and fifteen thousand rupees. It is further alleged that the younger sister of the informant was teased by the accused persons.
It is submitted by the learned counsel for the petitioners that the FIR was registered on 3.10.2014 but it reached to the court of the learned ACJM on 8.10.2014 which reflects that the FIR was
Patna High Court Cr.Misc. No.26120 of 2015 (2) dt.17-07-2015 2/2 lodged by antedating. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. It is further submitted that for the petty dispute the accusation has been levelled and the injury has been found to be simple. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Danapur P.S. Case No. 471 of 2014 pending in the court of learned ACJM, Danapur, Patna.
This application is disposed of with the aforesaid observation/direction.
