JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-07-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Fatehpur P.S. Case No. 89 of 2016 registered under Sections 272 and 273/34 of the Indian Penal Code and Section 47(A) of the Excise Act.

The accusation is that the police on receiving secret information about selling illicit liquor by the petitioner and his brother raided the house of Baleshwar Yadav, brother of the petitioner, from where, two Jarkin, each containing 40-60 litres country made liquor was recovered.

Learned counsel for the petitioner submits that 100 litres country made liquor was recovered from the house of

No.27855 of 2016 (2) dt.14-07-2016 Baleshwar Yadav and the petitioner is the brother of Baleshwar Yadav due to that reason he has falsely been implicated in this case with false allegation about selling of illicit liquor. It is further submitted that petitioner has no criminal antecedent and he is in custody since 20.04.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-X, Gaya, in connection with Fatehpur P.S. Case No. 89 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
