JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 The petitioner seeks regular bail in connection with Bhagwanpur P.S. Case No. 40 of 2003, registered for offences punishable under Sections 341, 307, /34 of the Indian Penal Code and alter on added Section 302 of the Indian Penal Code. Petitioner said to have fired on the deceased, who was taken to the hospital for treatment and it appears that he died later on after one month.

It has been submitted on behalf of the petitioner that materials collected in course of investigation and the case diary disclosed that he was under treatment for one month but later on he died due to heart failure. Petitioner has been in judicial custody since 28.01.2019 and charge has also been framed. Learned counsel for the state opposed the prayer for

Patna High Court CR. MISC. No.51477 of 2019(3) dt.20-11-2019 2/2 bail on the ground that there is allegation of firing against the petitioner.

Having heard both sides, considering the facts and circumstances of the case and the period of judicial custody of the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge -VII, Kaimur at Bhabhua, in connection with Bhagwanpur P.S. Case No. 40 of 2003 subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the Trial Court.
