2. The petitioners are apprehending arrest in connection with Town P.S. Case No. 90 of 2026, dated 29.04.2026, lodged under Section 115(2), 126(2), 109, 118(2), 303(2), 351(2), 352 and 3(5) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as "BNS, 2023").
3. As per the prosecution, the FIR has been lodged against nine named accused persons, including the present petitioners, with the allegation that they assaulted the informant's side at pistol point, due to which injuries were caused.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel further submits that the informant and the petitioners are residents of the same village and the same locality. Counsel further submits that, on the said date and place of occurrence, the informant's side had actually visited a local marriage ceremony and tried to outrage the modesty of a person, due to which a scuffle took place at the said place and they sustained injuries. In this regard, a Cr. Case bearing Town P.S. Case No. 89 of 2026 has been lodged, and on the same date, with a view to creating a defence, the informant's side lodged the present case. Counsel further submits that the entire family has been made accused in the present case. Counsel also submits that the criminal antecedents of the petitioners are not clean, as two criminal cases are pending against petitioner No. 1 and one criminal case is pending against petitioner No. 2, in which they are on bail.
5. Learned APP for the State opposes the prayer for bail of the petitioners but fairly submits that there is a case and counter-case between the parties.
6. Considering the facts and circumstances of the present case, let the above-named petitioners be released on

No.51380 of 2026(2) dt.29-07-2026 3/3 anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Judicial Magistrate 1st Class, Darbhanga, in connection with Town P.S.
