The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 504, 506 of the Indian Penal Code.

Learned counsel for the petitioners seeks permission to withdraw the petition with regard to petitioner No. 1.

Permission is accorded.

Patna High Court CR. MISC. No.62098 of 2021(4) dt.01-08-2022 2/3 Accordingly, the petition with respect to petitioner No. 1 is dismissed as withdrawn.

It appears that the application with regard to petitioner No. 2 has already been withdrawn vide order dated 04.07.2022.

It is alleged that all the accused persons including the petitioners assaulted the informant and others. It is only alleged against the petitioner No. 3 that he fired indiscriminately from his pistol.

It is submitted by learned counsel for the petitioner No. 3 that he has falsely been implicated in this case. The specific accusation of making assault to the informant and others is not against the petitioner No. 3. It is only alleged against this petitioner that he made indiscriminate firing but no one received any fire arm injury. A statement has been made in para 3 of the petition that petitioner No. 3 has no criminal antecedent.
