The petitioner apprehends her arrest for the offences alleged under Sections 467, 468, 471, 419, 420 and 120(B) of the Indian Penal Code, registered in connection with Arwal P.S.Case No. 157 of 2019.
The allegation against the petitioner is that she obtained job of panchayat teacher by producing forged certificates.
The learned counsel for the petitioner has submitted that the anticipatory bail petition of the petitioner was earlier rejected, vide order dated 16.10.2020 on the ground that in paragraph no.11, she wrongly mentioned that she was working, whereas as a matter of fact, she was terminated from
Patna High Court CR. MISC. No.9386 of 2021(4) dt.02-02-2023 2/2 her service at that time. He has submitted further that, while drafting paragraph no.11 of the anticipatory bail petition being Cr.Misc. No.75637 of 2019, due to mistake of the Advodate, it was mentioned that she was working. It was not the mala fide intention of the petitioner for inserting that fact in paragraph no.11 of the anticipatory bail petition. He has also submitted that in similar matter, a number of accused persons have been granted anticipatory bail by different Benches of this Court. Considering the above facts and circumstances, the petitioner is directed to surrender in the court below and seek regular bail, which shall be disposed of on the same day of its filing, without being prejudiced by the order passed in Cr.Misc. No. 75637 of 2019 dated 16.10.2020.
The learned court below may take notice of the fact that other accused persons of similar nature have been granted anticipatory bail, in other cases.
With these observations, the application stands disposed of.
