JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 25(1-B)a, 26 and 35 of the Arms Act.
As per the prosecution case, 710 grams morphine, one motorcycle, one country made pistol with one magazine and one Katta and four cartridges were recovered from the rental room of the petitioner.
Learned counsel for the petitioner submits that the said rental room of the petitioner was also in use of other persons and for recovery of narcotic substance, another case under the NDPS Act has also been registered. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 8.7.2021. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing
