2. The petitioners who apprehend arrest in connection with Triveniganj P.S. Case No. 448 of 2024 lodged on 28.10.2024 for the offences punishable under sections 126(2), 115(2), 352, 351(2), 303(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution, the F.I.R. has been lodged against six named accused persons, including the petitioners. It is alleged therein that all the accused persons surrounded the informant and assaulted him indiscriminately. When the elder brother of the informant came to rescue him, he was also

It is further alleged that petitioner no. 1 extracted 15,000/- from the pocket of the informant, while petitioner no. ₹ 2 and co-accused Manish Kumar Yadav snatched a silver chain from the neck of the informant and his nephew.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. The allegations against them are omnibus and general in nature. It is contended that all the sections invoked against the petitioners are bailable, except Section 303(2) of the B.N.S., 2023. The present case is a counterblast to Triveniganj P.S. Case No. 449 of 2024 lodged by the wife of petitioner no. 1 against the informant and his family members, in which the accused persons had brutally assaulted the petitioner and his wife, causing multiple injuries. It is further submitted that the informant and petitioner are gotias and, due to an admitted land dispute, the alleged occurrence took place, leading to the false implication of the petitioners and others. For an incident alleged to have occurred on 20.10.2024, the F.I.R. was lodged only on 28.10.2024, with a delay of eight days, which has not been explained. It is, however, stated that the petitioners are accused in two other criminal cases.
5. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.52157 of 2025(2) dt.12-08-2025 3/3 bail but submits that there is case and counter case between the parties being gotias.

In the facts and circumstances of the case, let the above-named petitioners be released on bail, in the event of their arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of 30,000/- ₹ (Rupees Thirty Thousand only) each, as mentioned in Section 2(1)(d) of the Bharatiya Nagrik Suraksha Sanhita, 2023, to the satisfaction of the A.C.J.M., Supaul, in connection with Triveniganj P.S. Case No. 448 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
