The petitioner seeks bail in a case instituted under Sections 302, 201 and 120(B) of the Indian Penal Code. The allegation against the petitioner is that he along with other accused persons committed murder of the daughter of the informant by putting her body on fire, after sprinkling kerosene oil, due to non-fulfillment of the demand of dowry. It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.07.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is father-

Patna High Court Cr.Misc. No.35015 of 2016 (3) dt.21-10-2016 2/2 in-law of the deceased. The alleged occurrence is said to have been taken place after 12 years of marriage. The allegation is of sprinkling kerosene oil and putting the deceased on fire. The Investigating Officer has examined the place of occurrence. In para-4 of the case diary, it has been stated that there was no kerosene oil found at the place of occurrence nor the smell of kerosene oil was found at the place of occurrence. It is submitted that the deceased died, while she was cooking. He is separate in mess and property from the husband of the deceased. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Karpi P.S. Case No. 44 of 2016.
