Petitioner challenges the order dated 14.08.2018 as
Patna High Court CWJC No.17350 of 2018 dt.30-08-2018 2/3 contained in Annexure-5 issued by the Chief Area Manager, Indane Area Office, Begusarai by which her application for award of LPG Distributorship at Ladaura, District Samastipur under OPEN (W) category for the Gramin Vitrak type of LPG Distributorship has been rejected and the amount of Rs. 40,000/- deposited with the Corporation would stand forfeited in view of Clause 11(h) & 11(i) of the advertisement.
Learned counsel for the petitioner submits that if there was any deviation as per the terms and conditions of the advertisement that could have been rectified as the LPG dealership was awarded to the petitioner.
Learned counsel for the Indian Oil Corporation submits that lease deed was in the name of the petitioner's husband, namely, Sri Ramesh Kumar and since it was not in conformity with the terms and conditions of land to be given for LPG Distributorship, the candidature of the petitioner has rightly been rejected.
Considering the rival submissions of the parties and on perusal of the registered lease deed which is contained in Annexure-2, the lease deed is in the name of the husband of the petitioner, Sri Ramesh Kumar which is not in accordance with the terms and conditions of the notice inviting tender for LPG
Patna High Court CWJC No.17350 of 2018 dt.30-08-2018 3/3 Distributorship and as per the Unified Guidelines for LPG Distributorship. This writ application has no merit. It is dismissed.
