The petitioner apprehends his arrest in Complaint Case No. 250 of 2012, registered for the offence punishable under Section 498(A) of the Indian Penal Code.
The complainant Farida Khatoon was noticed, but she did not appear as the service report shows that she was not residing for last four years at her address.
Learned counsel for the petitioner submits that the petitioner is not the husband of the complainant. From the voter list of Warsaliganj assembly constituency of the year 2009, the name of Farida Khatoon is at serial no. 490 she is the wife of Ezaz Ahmad who happens to be the brother of the petitioner.

No.8425 of 2015 (4) dt.05-05-2015 2/2 Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Nawada in connection with Complaint Case No. 250 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
