The petitioner apprehends his arrest in Kazi Mohammadpur P.S. Case No.374 of 2019, registered for the offences punishable under Sections 379 and 420 of the Indian Penal Code.
The allegation against the petitioner is that the petitioner got transferred Rs.40,000/- in his account from the account of the informant.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that after knowing the fact, the petitioner filed an application before the Branch Manager of
Patna High Court CR. MISC. No.7860 of 2021(2) dt.26-11-2021 2/2 the Bank for transfer of Rs.40,000/- from his account to the account of the transferee (Annexure-2). It is also submitted that both the parties have compromised the matter in the court below itself. There is no dishonest intention of the petitioner to cheat anyone.
Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.
Considering the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Muzaffarpur in connection with Kazi Mohammadpur P.S. Case No.374 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
