JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case, initially, registered for the offences punishable under Sections 457, 380 of the Indian Penal Code and later on, Section 411 of the Indian Penal Code was also added.

Although, it is alleged that stolen articles were recovered from rented room of the petitioner but having similar allegation, co-accused, Kundan Kumar Sah and Vikash Kumar @ Vikash Chauhan have already been granted privilege of bail by different Benches of this Court whereas petitioner is in jail custody since 22.07.2014 without having any criminal antecedent. Considering the aforesaid facts and circumstances as

No.33900 of 2016 (2) dt.20-08-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Mrs. Sheema Eram, Judicial Magistrate, Patna in connection with Phulwari Sharif P.S. Case No. 327 of 2014.
