The petitioner seeks bail in connection with Korha P.S. Case No.49 of 2016 registered under Section 376 of the Indian Penal Code besides Section 4 of the POCSO Act, pending in the court of the Additional Sessions Judge-I-cum-Special Judge, Katihar.
The accusation against the petitioner is that on 03.03.2016 at about 05.00 P.M., the petitioner enticed away the informant, aged about 16 years, in the maize field of Suresh Singh, where the petitioner forcibly committed rape on her. When she started to cry, nearby people gathered and the petitioner fled away.

Learned counsel appearing on behalf of the petitioner submits that on medical examination, the age of the informant has been assessed in between 17-18 years. The petitioner is in custody since 08.03.2016.
Having regard to the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected. (Rajendra Kumar Mishra, J) P.S./- U T
