The petitioner seeks pre-arrest bail in connection with Harpur P.S. Case No.38 of 2018 registered under Sections 379 and 411 of the Indian Penal Code and Sections 4 and 40 of the Bihar Minor Mineral Concession Rules, 1972.

It is submitted by the learned counsel for the petitioner that the owner of the truck has already been granted prearrest bail by the learned Session Judge, Munger vide order dated 31.07.2018 passed in ABA No.861 of 2018 as contained in Annexure-2 to the present application.

Regard being had to the reasons assigned in the aforestated order dated 31.07.2018, in the event of arrest or

Patna High Court Cr.Misc. No.55360 of 2018 (2) dt.20-09-2018 2/2 surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Munger, in connection with Harpur P.S. Case No.38 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
