2. Learned counsel for the petitioner submits that the order dated 16.05.2023 passed in Cr. Misc. No. 45651 of 2022 could not be carried out because the manner in which the petitioner was directed to file a joint affidavit as Opposite Party2 has not co-operated.

3. Considering the aforesaid submission made on behalf of the petitioner as well as the fact that the parties are husband and wife, the petitioner is directed to surrender before the trial Court / concerned Court. The concerned Court consider

Patna High Court CR. MISC. No.59051 of 2023(3) dt.22-09-2023 2/2 the regular bail of the petitioner on the same day and pass an order in accordance with law.
