JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Petitioner happens to be step son of the informant and it is alleged that petitioner and other F.I.R. named accused committed the murder of deceased, who happened to be step brother of the petitioner. The informant claims that deceased was killed due to property dispute as petitioner wanted to grab the entire property.

Perusal of the impugned order goes to show that the aforesaid facts were supported by the witnesses in course of

No.31245 of 2016 (2) dt.11-08-2016 2/2 investigation but admittedly, none has seen the actual killing of the deceased and only on the basis of property dispute, the fingers are being raised towards the petitioner. Moreover, the investigation against the petitioner has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Uda-Kishunganj, Madhepura in connection with Uda-Kishunganj P.S.
