JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner is said to have given blow to deceased by pointed weapon causing injury on his panjra. The post mortem report of the deceased corroborates the allegation. Moreover, a piece of sickle is said to have been recovered from the place of occurrence.

Considering the allegation levelled against the petitioner as well as facts and circumstances of the case, I am not inclined to release the petitioner on bail and hence, his prayer for

Patna High Court Cr.Misc. No.29755 of 2016 (2) dt.28-07-2016 2/2 bail in connection with Bhairab Asthan P.S. Case No. 87 of 2015 pending in the court of Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani stands rejected.
