JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 20.11.2017 passed in Cr.Misc.No. 52256 of 2017 with direction to learned trial court to expedite the trial and conclude the same within a period of nine months. It appears that there is allegation of recovery of 14 kg. of ganja from the petitioner at the Railway Station.
Submission of learned counsel for the petitioner is that the said ganja was not recovered from his conscious possession and other co-accused persons have been granted bail by different Benches of this Court vide order dated 4.12.2017 passed in Cr.Misc.No. 50404 of 2017, vide order dated 10.1.2018 passed in Cr.Misc.No. 62922 of 2017 and vide order dated 21.6.2018 passed in Cr.Misc.No. 19927 of 2018. Further submission is that petitioner is in custody since 8.8.2017 and the alleged recovery is less than commercial quantity.

Having heard both sides and in the facts and circumstances and also considering the period of detention, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Bhojpur, Arrah, in connection with N.D.P.S.Case No. 28 of 2017, arising out of Ara Nawada P.S.Case No. 315 of 2017, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in disposal of trial and appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
