JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2019 This application, for grant of anticipatory bail, arises out of Gopalganj Town P.S. Case No. 168 of 2019, disclosing offences under Sections 414, 413, 120(B) of the Indian Penal Code and Section 30(a), 37(b)(c) of Bihar Prohibition and Excise Act, 2018 and under Section 25(1-b)a/26/35 of the Arms Act. Prosecution case is that police received a secret information that in a Maruti Celerio car some miscreants are coming and on the verification of the said information, police went there and intercepted the said car, then all person sitting in the car started fleeing away, however, on chase four of them were caught while one succeeded in fleeing away and the apprehended persons disclosed the name of petitioner as their associate and, thereafter, on search of the Car one bottle of 750 ML Royal Stag Liquor, a country made pistol and .315 cartridge were recovered.

No.50595 of 2019(2) dt.14-08-2019 2/2 Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been made accused in this case only on the basis of disclosure made by the apprehended co-accused persons and except that there is nothing against the petitioner.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 02nd Additional Session Judge -cum-Special Judge, Excise Act, Gopalganj, in connection with Gopalganj Town P.S. Case No. 168 of 2019 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
