JUSTICE BIRENDRA KUMAR ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/120B/201/34 of the Indian Penal Code and Section 27 of the Arms Act.

The police officer is the informant of this case. The F.I.R. was lodged on notice of two dead bodies by the river side. The blood was found near the house of the petitioner, hence, the petitioner was suspected.

The petitioner lodged Baniyapur P.S. Case No.96 of 2016 stating therein that Arun Singh and others had stayed at his house in the night to watch the cultural programme nearby and in the same night said two persons were murdered.

Patna High Court Cr.Misc. No.27891 of 2016 (7) dt.14-12-2016 Learned Additional Public Prosecutor submits that case-diary reveals that there is no eyewitness of the occurrence. Petitioner is in custody since 15.02.2016. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra/Successor Court, in connection with Baniyapur P.S. Case No.45 of 2015.
