Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 376 & 504 of the Indian Penal Code. Earlier prayer for bail of the petitioner was rejected by this court vide Annexure-1 to this application taking note of the medical report of the victim in support of the allegation made in the FIR.

A report was called for regarding the stage of the case. From the report, it appears that NBW has been issued against the prosecution witnesses. The trial is expected to be concluded within a period of nine months.

Patna High Court CR. MISC. No.49366 of 2019(3) dt.18-12-2019 2/2 Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner in connection with Spl. (P) Case No. 18 of 2017 arising out of Mahila P.S. Case No. 28 of 2017 is rejected.

The trial court is directed to take all possible steps to expedite the trial of the petitioner and conclude the same, preferably within a period of nine months from the date of receipt/production of copy of this order.
