Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Rupauli (Mohanpur) P.S. Case No. 101 of 2020 for the offence punishable under Sections 341, 323, 307, 379, 504 and 354 of the Indian Penal Code.

It is submitted by the petitioners that they have

Patna High Court CR. MISC. No.7711 of 2021(2) dt.01-12-2021 2/2 falsely been implicated in the present case because of the land dispute. It is further submitted by the petitioners that it is the informant who has taken the land of the petitioner on rent/lease and when the petitioners asked to return the land, this false and fabricated case has been registered against them. The injury report also shows that the injury sustained by the victim is simple in nature.

Considering the aforesaid facts, this application is allowed.

Let the petitioners, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea, in connection with Rupauli (Mohanpur) P.S. Case No. 101 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
