The petitioner seeks bail in Khagaria (Muffasil) P.S. Case No. 206/2018, instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 302 and 448 of the Indian Penal Code read with Section 27 of Arms Act.
Learned counsel for the petitioner has submitted that in the written report, there is specific allegation of causing firearm injury against co-accused Anuj Yadav, Rajendra Yadav and Manish Yadav. Petitioner is named in the written report merely as a member of unlawful assembly.
Petitioner is in custody since 03.08.2018.
Considering the aforesaid fact and circumstances,
Patna High Court Cr.Misc. No.57642 of 2018 (2) dt.09-10-2018 prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S.
