1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The learned counsel appearing on behalf of the petitioners after some argument seeks permission to withdraw the anticipatory bail application with respect to petitioner no.2, namely, Prem Vaibhav @ Bittu.
3. Permission is accorded.
4. The petitioner apprehend his arrest in connection with Agamkuan P.S. Case No.372/2025, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 3(5) of the B.N.S., 2023.

The learned counsel for the petitioner submits that petitioner no.1 is a person with clean antecedent and the informant alleges that on 07.05.2025, Prem Vaibhav called him and asked him to come at his shop, which is run by his mother, on pretext of returning money, accordingly, the informant along with his friend Vikash came to his shop, where Prem Vaibhav, Vibha Sinha, Narendra Kumar along with 8-10 accused persons were present, thereafter it is alleged that the accused persons assaulted the informant and his friend causing injury on left hand of the informant and his friend suffered head injury.
6. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant being father of Prem Vaibhav. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that it was Prem Vaibhav who had called the informant at his shop on pretext of returning money when the occurrence is alleged to have taken place. It is next submitted that the informant did not suffer any major injury but then Vikash who had accompanied the informant was assaulted by the accused persons including the unknown accused. It is next submitted that there is no specific allegation of assault against the petitioner. It is reiterated and submitted that petitioner has been implicated in

It is next submitted that from perusal of the order impugned, it would manifest that Vikash suffered head injury for which he was admitted in CNS Multispeciality hospital for ten days where his left FTP Craniotomy and evacuation of EDH was done.
7. Learned APP opposes the anticipatory bail application of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Agamkuan P.S. Case No.372/2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
