The petitioner seeks bail in a case registered for the offence punishable under Section 419, 420, 424, 467, 468, 471 and 474/34 of the Indian Penal Code.

The petitioner is said to be a member of Organized Bihar People Liberation Army, whose main business is to collect ransom from various companies and contractors. During course of investigation, several mobiles with SIM, blue colour diary, voter I.D. card, PAN card and two bank pas books and collected amount of rangdari were recovered.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. He is neither named in the F.I.R. nor was apprehended on the spot.

The allegation levelled against the petitioner is not specific rather general and omnibus in nature. It is further submitted that similarly situated co-accused have been enlarged on bail by different coordinate Bench of this Court. The petitioner has been languishing in custody since 10.06.2016.

Learned APP for the State opposing the bail petition submitted that the petitioner is a member of a organized gang and two engineers were murdered and petitioner was active in helping the co-accused. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail, after framing of charge, and on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Baheri P.S. Case No.51 of 2016.
