The petitioner is apprehending arrest in connection with Garbandanga P.S. Case No. 39 of 2021 for the offence registered under Sections 394 and 397 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution story, the informant was going on his motorcycle when three persons chased him and one of them opened fire causing injury on his thigh. A he fell down, they fled away after looting silver jewellery (400 gms) as also Rs. 12,000/-. Accordingly, the FIR was lodged. From the FIR, it seems that the informant is in the business of jewellery and under well thought plan, he was

No.52432 of 2022(3) dt.17-01-2023 2/2 intercepted and the accused persons after injuring the informant straightaway opened the motorcycle dicky and took away the silver ornament (400 gms). The name of the petitioner came in the confessional statement of co-accused. Further paragraph-3 shows that the petitioner has three criminal cases lodged against him the details of which have not been given in the said para. Considering the aforesaid facts, this Court is not inclined to grant him the privilege of bail and the same stands rejected.
