The petitioner, who is in custody, seeks bail in connection with Thawe P.S. Case No. 101 of 2018 registered for the offence punishable under Sections 379, 411/34 of the Indian Penal Code.
Allegation in the FIR is that petitioner alongwith others entered into the room of the informant and after breaking the lock of the boxes and atachi took away golden chain, Mangalsutra, ear ring and mobile also. When the informant came there all of them except one Sonu Dubey fled away. Sonu Dubey was caught by the villagers and he confessed the name of petitioner and one another.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.60791 of 2018(2) dt.11-10-2018 2/2 petitioner is innocent and has been falsely implicated in this case due to village politics. Nothing has been recovered from his possession. Co-accused Sonu Dubey has named the petitioner in his confession due to animosity. Petitioner is in custody since 18.06.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj, in connection with Thawe P.S. Case No. 101 of 2018.
