JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 307, 504 and 302 of the Indian Penal Code.
There is specific allegation against the petitioner that he poured kerosene oil and lit fire on the body of the informant, who died in course of treatment. The fardbeyan of the informant appears to be her dying declaration.
Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail. Hence, his prayer for bail in connection with Sessions Trial No. 119 of 2015, arising out of K.Nagar (Champa Nagar) P.S. Case No. 434 of 2014 stands rejected.
