JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mufassil P.S. Case No. 11 of 2016 instituted for the offence under Section 392 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. His name has come in the confessional statement of co-accused Amarjeet Kumar and Sonu Kumar. Counsel for the petitioner further submits that Amarjeet Kumar and Sonu Kumar have already been granted bail by coordinate Benches of this Court vide orders dated 02.02.2017 and 08.03.2017 passed in Cr. Misc. 857 of 2017 and 10081 of 2017 respectively.

It is submitted that Test Identification Parade was held

Patna High Court Cr.Misc. No.55738 of 2018 (2) dt.20-09-2018 2/2 and informant has identified the petitioner. But the stolen Motorcycle was recovered from possession of co-accused Sonu Kumar.

Petitioner is said to be in custody since 30.06.2016. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Aurangabad, in connection with Mufassil P.S.
