The petitioners seek bail in a case instituted under Sections 364, 120B and 302/34 of the Indian Penal Code. Allegation is that son of the informant has been abducted by the F.I.R. named accused persons due to old enmity. It has been submitted on behalf of the petitioners that they are in custody since 4.3.2016. Chargesheet has been submitted against the petitioners. Petitioners have got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioners. Informant is not an eye witness to the alleged occurrence. Petitioners have been named merely on the basis of suspicion. There is no eye witness to the alleged occurrence. Other co-accused have been granted bail vide Cr. Misc. no. 33031 of 2016, Cr. Misc. no. 29949 of 2016 and Cr. Misc. no. 28709 of 2016.

On behalf of the State and the informant, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.29923 of 2016 (3) dt.06-09-2016 2/2 above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VIII, Siwan, in connection with Daraunda P.S. Case no. 34 of 2016.
