The petitioner seeks bail in Motihari Rail P.S. Case No. 27/2018, instituted for the offences under Sections 401, 414 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner has clean antecedent. In the written report, it is alleged that on the statement given by one Shanti Bai, petitioner along with others were arrested by the police. The police made search of the petitioner. As per seizure-list several ornaments, Rs. 3,000/- cash and cards of S.B.I. have been recovered from his possession. It is further submitted that no any case has been lodged

Patna High Court Cr.Misc. No.56536 of 2018 (2) dt.04-10-2018 2/2 for aforesaid articles. The other co-accused, namely, Shanti Bai has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 48554/2018 dated 18.08.2018. Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Motihari Rai P.S. Case No. 27/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J.) Rakhi U T
