====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 09-08-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.

Petitioner is father-in-law of the victim of dowry death. Death was caused within one year of marriage allegedly for non-fulfillment of dowry demand.

It has been informed by learned counsel for the petitioner that husband of the victim is already in custody. Petitioner is aged about 63 years and he is in custody since 26.03.2019. Investigation of the case is already complete. The allegation is general and omnibus against the petitioner. Learned counsel for the informant opposed the prayer

Considering the entire facts of the case aforesaid, especially, the general and omnibus nature of allegation against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 381 of 2019 arising out of Baniapur Police Station Case No. 97 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
