JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The statement of victim has been recorded under section 164 of the Cr.P.C in which she stated that she was ousted from her home by her father and, after that, she went to the house of petitioner and got solemnized her marriage with the petitioner.

No doubt, the age of victim has been assessed as 16 years at the time of recording her statement under Section 164 of the Code of Criminal Procedure by the learned Judicial Magistrate but even if the aforesaid assessment is assumed to be correct, then also, the victim is about to attain the majority. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.
