At the very outset, Mr. Rajiv Ranjan, learned counsel for the petitioner, prays to withdraw this bail application on behalf of petitioner no.2, namely Aklu Mahto. 3.

Permission is granted.

Accordingly, the bail application of the petitioner no.2 is dismissed as withdrawn.

5. The petitioner no.1 apprehends his arrest in connection with Musahari P.S. Case No.41 of 2024 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

It has been submitted by the learned counsel

Patna High Court CR. MISC. No.55428 of 2024(2) dt.31-08-2024 2/2 for the petitioners that there is general and omnibus allegation against the petitioner no.1 for demand of dowry and torture and thereafter, killing the deceased. The petitioner no.1 namely, Mahesh Mahto is cousin father-in-law of the deceased and there is general and omnibus allegation against him.

7. Considering the aforesaid facts and circumstances of the case, the anticipatory bail petition is allowed on behalf of petitioner no.1.

Let the petitioner no.1 above named, in the event of his arrest/ surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Muzaffarpur in Mushari P.S. Case No.41 of 2024, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Sandeep Kumar, J) N.K/- U T
